A mother is suing the manufacturer of Zofran, saying that the drug resulted in her son being born with numerous congenital defects. The woman said that she was prescribed the drug while she was pregnant, and taking it caused her son to have respiratory distress syndrome and cleft palate.

The woman says that when she was prescribed the drug, her doctor told her that it would help her with symptoms of morning sickness. However, she says that she was never told about the inherent risks associated with the medication. She says that drugmaker, GlaxoSmithKline, LLC, is strictly liable for its failure to inform her of risks and associated negligence relating to deceptive trade practices, breaches of warranty, design defects and other wrongdoing.

The lawsuit is asking for compensation for all damages suffered by the woman and her son. She says that her son’s entire life has been affected negatively by the health conditions resulting from the medication. She is further asking to be compensated for attorneys fees expended during the litigation of her claims.

Texas residents should be warned: Not all pharmaceutical drugs are safe, even if they have been approved by the FDA. Indeed, a lot of drug dangers are not revealed until numerous people fall ill or die as a result of taking the medications. It is only then that recalls are issued and the dangers of a particular drug become public knowledge, but this is often too late. If you or a loved one have been harmed by a dangerous drug, you may be entitled to seek financial restitution from the drugmaker in court.
