How The Texas Attorney General’s Investigation Into Discord Started a Wave of Litigation
Texas Attorney General Ken Paxton opened an investigation after police revealed that the suspect accused of assassinating Charlie Kirk had used the platform to communicate, radicalize, and coordinate actions. Paxton used this to determine the details of how the platform’s architecture facilitates extremist networks.
Concurrently, Paxton’s office received a wave of complaints indicating the platform was heavily used for exploiting children. He used the Texas Securing Children Online Through Parental Empowerment (SCOPE) Act to probe the company on three fronts:
- Extremist Content: How the platform monitors/moderates groups targeting children.
- Sexual Exploitation: The volume of grooming rings and child sexual abuse material (CSAM) circulating through private servers.
- Platform Addiction: Whether developers deliberately designed features to foster unhealthy digital addiction among minors.
The results of the October 2025 investigation provided the data points, case studies, and evidence that Paxton used to bring the lawsuit against Discord for deceptive claims regarding the application’s misleading safety settings and allowing online predators to exploit children.
In the formal complaint, Paxton’s public statement spared no feelings. We live in a time where the dangers children face online have never been greater, and every parent in Texas deserves to know their child is protected,” Paxton further described the platform as having “designed a predator’s paradise, switched off the safeguards by default, and looked Texas parents in the eye and called it safe.“
Paxton’s complaint cites 35 criminal cases involving kidnapping, grooming, or sexual assault, and 165 cases of transmission or receipt of child sexual abuse material. Texas AG Paxton seeks up to $10,000 per DTPA violation plus disgorgement of revenue.
The same day, Paxton’s office secured an emergency restraining order. This is the first time a court has bypassed Section 230 protections to change how an application works. It requires the platform to instantly change default settings for all Texas children’s accounts to maximum safety settings:
- fully blocking harmful content
- stopping direct message permissions from non-friends
- disabling friend requests from “Everyone.”
- setting spam filters to “Filter All.”
The court also required the platform to suspend the 90-day Discord user violation record expiration, preserve all data, and disclose all default settings, the percentage of company staff devoted to developing/monitoring safety tools, and data for blocked/banned users and how easy access is to return to the website.
What are the Lawsuits Against Discord About?
Parents and State AG complaints allege Discord’s design lacks meaningful moderation for private servers and private messaging, since the platform relies on unpaid volunteer moderators. Discord didn’t require age verification for users until 2026, when parents and courts across the country started demanding a safer online experience.
This created a safe haven for predatory behaviors. Online predators use private servers and messaging to target, groom, and exploit children, all while Discord markets the platform as a safe space for children, misleading parents and causing widespread harm.

Child Predators Grooming Children and Child Sexual Abuse
Discord’s private messaging system, encrypted servers, and lack of meaningful monitoring have created conditions that lawsuits allege allow sexual predators to reach children and groom them.
According to Discord’s Q2 2022 transparency report, the platform disabled 532,498 accounts for child safety violations in a single quarter, 497,267 of which involved child sexual abuse material.
The “764”, an extremist network operating on nihilistic violence and described as “one of the most depraved and dangerous child abuse cults in modern history,” in a wrongful death lawsuit, was described as operating openly on Discord servers. The group has been directly connected to child deaths, including the suicide of 13-year-old Jay Taylor.
A recurring connection runs through these cases: online predators use gaming platforms, like Roblox, to make initial contact, move children to Discord, then coerce child users to send sexually explicit material or sexually assault them in real life.

No Meaningful Age Verification
Anyone can create an account without identity verification, relying entirely on self-reported ages that a minor can falsify in seconds. The default settings for child user accounts aren’t set to maximum safety settings, and the platform’s privacy and moderation controls are buried in menus that parents who aren’t tech-savvy cannot easily find, configure, or monitor. The result is that children enter with the same level of exposure as adults and online predators know it.
Deceptive Claims Involving Child Safety
Discord markets itself as being a safe space for child users. Their marketing team’s public statement claimed safety was “at the core of everything we do,” and “fully integrated into our design process.” A Discord spokesperson wrote in a statement, “The lawsuit’s characterization of Discord does not reflect the platform we have built or the investments we have made in user safety.”
State AG lawsuits against Discord tell a different story of the alleged safeguards.
State AG Paxton argues that the company staffed its most critical safety functions with unpaid moderators, had default settings set to minimum protection, had expired violation records after 90 days, and buried the block button.
Paxton’s lawsuit against Discord quotes federal prosecutors describing the architecture as “a hunting ground to find, manipulate, and sextort our most vulnerable.” New Jersey’s AG similarly alleges Discord relied on unpaid, untrained volunteer moderators even in servers that catered explicitly to children.

Courts are now treating this as a systemic issue. Over 130 Roblox predator cases have been consolidated in the Northern District of California, with Discord named as a co-defendant or contributing platform in many of them.
