Taxotere (docetaxel) is an intravenous injection manufactured by Sanofi-Aventis. It is primarily used to treat breast cancer but is also used to treat an array of different types of cancers. One side effect of Taxotere is permanent hair loss or alopecia, with between 10 and 15 percent of women reporting no hair growth for as many as 10 years after treatment ended. Because of this devastating and undisclosed side effect, Taxotere lawsuits have started to be filed all over the country.
The First Lawsuit: Mississippi
The first Taxotere lawsuit was filed in Mississippi by a woman who was diagnosed with cancer in 2006. After taking Taxotere, she suffered permanent alopecia which has continued to affect her more than 10 years later. As part of her claim, this woman stated that she was not warned of this devastating side effect and neither was her physician.
The First Texas Lawsuit
The first Texas lawsuit was filed in June of this year by a woman who also experienced permanent alopecia as a result of taking Taxotere. Like the woman in the Mississippi, this Texas plaintiff described this side effect as "severe," and causing "debilitating emotional distress" and greatly "impairing the quality and enjoyment of life."
The Ever-Growing Docket Of Taxotere Cases: MDL Sought
Since the warning about permanent hair loss was made public, countless lawsuits spanning across 16 federal courts have been filed. The number of claims should not be surprising, given that thousands of women have been exposed to the drug without being warned about this horrible side effect. Because of the number of claims continues to grow extensively, attorneys have requested for the cases to be sent to multidistrict litigation or MDL. Claims span from everything to negligence, fraud and failure to warn. Currently, the Eastern District of Louisiana is being pushed as the central location for the MDL litigation to take place.
